I have appointed my Friends Thomas Shipton, Farmer and Richard Sutton, Farmer and Blacksmith both of this parish of Foston and Scropton in the County of Derby and my dear wife Ann Tipper to be my Executors and Executrix of this my Will, and I do give them power to take possession of all my real and personal estates at my decease to have and to hold them in for the mutual benefit of my wife and children herein after mentioned and to pay all my just debts and personal expenses and testamentary out of my real or personal estates and to receive all rents and profits arising from my real or personal estates and to give for the same and to carry this my Will into effect after my decease for the mutual benefit of my wife and children hereinafter directed. I give my dear wife, Ann Tipper all my real estate namely all my two fields of land I bought by auction and legally conveyed to me by the executors of the late William Moor of Hatton situate in the Township of Hatton in the Parish of Marston on Dove in the County of Derby on either side of the highway leading from Scropton to Tutbury and the several houses and buildings and tenement erected thereon, I give them all to my dear wife, Ann Tipper for her natural life but if my dear wife should marry again I then on the day of her second marriage withdraw all of my real estates from her and I give her fifteen pounds per annum for her natural life in lieu thereof And I give my dear wife Ann Tipper all my personal estates namely all my household furniture, plate, books, book debts, ready money, railway trucks, stock in trade, live and dead farming stock and whatever else is found in my possession of a personal character belonging to me I give them all to my dear wife for her natural life but if my dear wife marry again I then withdraw all these my aforementioned personal estates from her on the day of her second marriage and I give her the aforementioned fifteen pounds only for her natural life to be raised out of my aforesaid real estates and no more. And I do further direct that all my aforesaid real estates shall be given to all my family of children at the decease of my dear wife or on the day of her second marriage if such marriage should take place then my wife shall give up all claim on all my aforesaid real and personal estates with the exception of the fifteen pounds per annum as aforesaid. I then give to my son, James Tipper and to my daughters Ellen Tipper, Ann Tipper and my Son Ernest William all my children I give them all an equal undivided share of these my real and personal estates as aforementioned at the age of twenty one years if the second marriage of my wife has taken place I give to them absolutely for their heirs executors administrators or assigns for ever. And I further direct that all my real and personal estates shall be valued by a man of sound principle and good understanding after the decease of my dear wife or on the day of her second marriage if such marriage should take place and shall be divided in equal shares amongst all my aforesaid children and if these children think well to rent each others share or shares or carry on business jointly they may do so but if any think well to sell his or his share or shares in this my Will they shall at first offer them for such sale to each other before they offer them for sale to any disinterested person subject to the aforesaid annuity of my wife's second marriage if such marriage should take place And if any of these my trustees die or wish to be relieved from this my Will they may be so relieved by them choosing and appointing fresh trustees to act in their places that are of an honest and upright dispositions to carry this my Will into effect and intended use And I do give my trustees power to repay themselves any expenses they may have incurred in carrying this my Will into effect and my intended use out of my real or personal estates And I do hereby revoke all other former Wills made by or for me of any former date and do declare this to be my last Will and Testament before John Shephards, Farmer and Coal Merchant and Frederick Harrison, Coal Merchant both of the Township of Hatton in the County of Derby my chosen witnesses on this third day of March one thousand and eight hundred and sixty nine and I have subscribed my name hereunto on three sheets of paper in the presence of my aforesaid witnesses and in the presence of each other and they have signed this my last Will and Testament in my presence

MOTORIST AND COWS ON THE ROAD
Robert James Bull, farmer, of Etchells Farm, Church Broughton, brought an action against A.O.Fuller, of the Royal Hotel, Derby, for £42, the value of a cow, which plaintiff alleged defendant ran into with his motor-car and injured it so seriously that it had to be slaughtered. Mr T H Bishton, of Leek, appeared for plaintiff and Mr A R Flint for defendant.- Opening the case for the plaintiff, Mr Bishton said the plaintiff’s cowman was driving 50 or 60 cows out of a field into the road, when the defendant ran into one cow with his motor-car, and knocked it down. He contended that defendant must have been driving at an excessive speed. The cow was struck on the left hind leg, which was broken; two ribs were also broken and its shoulder injured. A veterinary surgeon was called, and ordered the cow to be slaughtered. This was done, and the carcass was sold to a local farmer and butcher for £7. On the following Friday plaintiff and another farmer saw defendant, who told him he regretted what had occurred, and that if a reasonable claim was made it would be paid. Defendant also said: "I didn't think it was hit, because I was only going slowly." Since then, in a letter, defendant said he was absolutely standing still. The cow would now have been of the value of £55. The accident happened at four o'clock on the afternoon of September 11.- Fred Billinge, the cowman, gave evidence, and in cross-examination denied that the defendant told him the cow put its foot under the wheel.- John Archer Wedd, a local butcher and farmer, described the injuries to the cow, and Frank Horton, veterinary surgeon, Tutbury, spoke to finding the cow lying on the grass by the side of the road, with its leg broken, and he ordered it to be slaughtered. - In reply to Mr Flint, witness said he did not consider the cowman could have had much control over the first of the herd of cows coming out of the field. - Plaintiff gave evidence as to the value of the cow, and said it was seven years old and gave four gallons of milk daily. - William Tipper, a neighbouring farmer, who was present at the interview between plaintiff and defendant, said the latter told them he had had to pull the mudguard of the car up. - Mr Flint submitted that there was no evidence of negligence. - The Judge: oh, yes, there is. In my opinion anybody meeting a herd of cows who keeps his car moving so as to run into a cow and knock it down is guilty of negligence.- The defendant gave evidence that he turned into the lane and met a herd of cows. He could not at first see the man at all. He approached the cows very slowly, and by the time he got up to the first cow the car was absolutely standing still. He made a noise with the engine, and the cows pushed one another away from the car, and one got its foot under the wheel; the cow struggled, sat on its rump, and rolled over. He got out of the car, and had to wait some minutes until the man came up. - Replying to the Judge, defendant said he was absolutely certain he had stopped the car, but admitted he did not know how the cow's ribs were broken. - Mr Flint said the position would be intolerable if a motorist had to pull up every time he met cows. He also argued that it was impossible for the cowman to say precisely what happened when he was fifty yards away, and was not in a position to see. The injuries implied that the cow must have been broadside on to the car, and he argued that the injury to the fetlock must have been done by the pinioning of one of the cow's feet under the wheel and its struggling.- Summing up, the Judge said that the evidence was that the car was in motion when it struck the cow. He did not intend to reflect on Mr Fuller’s probity or intelligence. He could not rely upon his evidence, because he did not think he had a clear idea of what happened or that his memory was accurate about what happened. That was not a reflection on his intelligence, because it was rare indeed to find in such cases a witness who had a very accurate recollection of events. He had often seen cases of the negligent driving of cattle on the road, and in this case the man must have been a good deal more than the 50 yards to the rear he said he was. Farmers were entitled to drive cattle along the road, and could not be expected to provide enough men to make them safe. Of all people drivers of cars had the greatest control over the movements of their machines, and in his opinion it was their duty in such circumstances to go so slowly as to be able to stop in a fraction of a second. Some people might think that was an intolerable burden, but if they kept moving they did so at their own risk. - Judgement was given for the amount claimed.13

I have appointed my Friends Thomas Shipton, Farmer and Richard Sutton, Farmer and Blacksmith both of this parish of Foston and Scropton in the County of Derby and my dear wife Ann Tipper to be my Executors and Executrix of this my Will, and I do give them power to take possession of all my real and personal estates at my decease to have and to hold them in for the mutual benefit of my wife and children herein after mentioned and to pay all my just debts and personal expenses and testamentary out of my real or personal estates and to receive all rents and profits arising from my real or personal estates and to give for the same and to carry this my Will into effect after my decease for the mutual benefit of my wife and children hereinafter directed. I give my dear wife, Ann Tipper all my real estate namely all my two fields of land I bought by auction and legally conveyed to me by the executors of the late William Moor of Hatton situate in the Township of Hatton in the Parish of Marston on Dove in the County of Derby on either side of the highway leading from Scropton to Tutbury and the several houses and buildings and tenement erected thereon, I give them all to my dear wife, Ann Tipper for her natural life but if my dear wife should marry again I then on the day of her second marriage withdraw all of my real estates from her and I give her fifteen pounds per annum for her natural life in lieu thereof And I give my dear wife Ann Tipper all my personal estates namely all my household furniture, plate, books, book debts, ready money, railway trucks, stock in trade, live and dead farming stock and whatever else is found in my possession of a personal character belonging to me I give them all to my dear wife for her natural life but if my dear wife marry again I then withdraw all these my aforementioned personal estates from her on the day of her second marriage and I give her the aforementioned fifteen pounds only for her natural life to be raised out of my aforesaid real estates and no more.
